Introduction to Electronic Discovery and Evidence
Professor Hedges J.D. Seminar 374 | 1 credit hours This course focuses on discovery of information that is generated and stored in electronic format. Requests for electronic information, and disputes arising from such requests, are now common in the federal and State civil justice systems. The course will examine how discovery requests are made and responded to, how disputes are addressed under the Federal Rules of Civil Procedure, and how the 2006 amendments to the Rules impact on requests, responses, and the resolution of disputes. The course will also examine the evolving law of privilege and work product, “search” for relevant electronic information, and the ethical duties of lawyers in electronic discovery. The course will also introduce students to the use of electronic information in the criminal justice system as well as the presentation of evidence in electronic format at trial and other proceedings. Prerequisite: Civil Procedure (or the equivalent Legal Process and Society). Students may not receive credit for both this course and Electronic Discovery Seminar.
