Litigation Risk Management Seminar
Professor Jonathan Molot J.D. Seminar 571 | 2 credit hours The seminar explores how litigants and their lawyers manage litigation risk. Selected readings, mostly from law review articles, cover a variety of topics including alternative fee arrangements, litigation and settlement dynamics, specialized risks from punitive damages and class actions, and innovative business models designed to transfer or pool litigation risk. Given that modern litigation is largely an exercise in risk management, the course will seek to provide a useful framework for students interested in pursuing a career in litigation. The required work will include a seminar paper and oral presentation at the end as well as a shorter presentation during the semester.
