Mental Health Issues in Criminal Law
Professor Newton J.D. Course 307 (cross-listed) | 2 credit hours This course will address mental health issues that commonly arise in criminal prosecutions, including mental incompetency and the involuntary administration of anti-psychotic medication; insanity and other mental health defenses; substance abuse issues; mental retardation; mental health issues in death penalty cases; the use of psychological and psychiatric expert witnesses; and the civil commitment of sex offenders, incompetent pretrial detainees, and defendants found not guilty by reason of insanity. In addition to discussing relevant appellate case law and statutes, this course will focus on several notable trials dealing with mental health issues (e.g., State of Texas v. Andrea Yates and United States v. Theodore Kaczynski). Occasional guest lecturers with an expertise in particular psychiatric and psychological issues will make presentations.
