Detention, Trial, and Lethal Targeting in a Post 9/11 World
Professor Daskal LL.M Seminar 2041 | 2 credit hours This seminar will explore the law and practice relating to the detention, trial, and lethal targeting of al Qaeda and its associates since September 11, 2001. We will analyze executive actions and the seminal Supreme Court rulings as well as key Circuit and district court cases, examining both the substantive standards and procedures applied. Specific topics will include the military commissions, law of war standards for detention and targeting, extraterritorial application of constitutional rights, and discrete issues related to covert action. Several classes will also be devoted to case studies, thereby providing an opportunity to apply the concepts discussed to the analysis of specific real world scenarios. Evaluation will consist of 50% final paper (25 page minimum for three credits; critical response papers for two credits) and 50% class participation and preparation. Recommended: Constitutional Law I and International Law I: Introduction to International Law.
