Professor Carabillo J.D. Course 223 (cross-listed) | 2 credit hours This course focuses on the legal and practical issues involved in the field of insurance. Specific areas covered include basic principles of insurance (risk, underwriting, claims); the changing nature and extent of government regulation the McCarran-Ferguson Act, The Terrorism Risk Insurance Act; the rights, duties, and liabilities of agents and brokers; the various legal liabilities associated with property/casualty, liability, and life/health insurance and with reinsurance; plaintiff’s remedies and the common law and statutory defenses available to insurers in general and for certain forms of insurance; and the problems associated with the claims process ("bad faith").
