Strategic Decision-making in First Amendment Litigation Seminar
Professor Vladeck J.D. Seminar 420 | 3 credit hours This Seminar explores the process of strategic decision-making in First Amendment test case litigation. Focusing on the evolution of the commercial speech and compelled speech doctrines, the seminar will give students an opportunity to see how litigation decisions concerning case selection, forum choice, and issue presentation often have profound effects on the development of constitutional doctrine. In addition to analyzing the relevant cases, students will examine the briefs and records in selected cases to see how the lawyers' role in molding the case influenced the ultimate outcome. The students will also examine an ongoing case and discuss decision-making in complex First Amendment litigation with experienced practitioners. A paper is required.
